The decision will ultimately lie with a Los Angeles Superior Court judge, with a hearing expected within the next 30 to 45 days. Gascón supports a modified sentence to life with parole eligibility, noting that, under California law, the brothers qualify for youthful parole due to their ages at the time of the crime.

The DA highlighted the Menendez brothers’ positive records in prison, where they have served as “model prisoners” and contributed to inmate programs.
