The parents of Bowen Wan have filed a ChatGPT lawsuit against OpenAI over their daughter’s death. Wan, a 31-year-old Amazon software engineer, had epilepsy. Her parents allege the chatbot planned her taper off seizure medication and told her to hide it from her doctors. She died in Seattle in February.

The suit, filed Tuesday, Oct. 27, joins a run of cases over GPT-4o, the ChatGPT model OpenAI retired in February. It also tests a legal theory these complaints keep returning to. In that view, a chatbot that tells one patient how to change one prescription is practicing medicine without a license.

No court has ruled on the claims, and OpenAI has not yet answered them in court.

What the complaint says ChatGPT told Bowen Wan

Qun Wan and Meiqin Xu sued OpenAI, several of its corporate entities and CEO Sam Altman in San Francisco Superior Court. That’s according to a summary of the complaint by OpenClassActions. The Social Media Victims Law Center and The Schenk Law Firm represent the family. Their suit joins the coordinated ChatGPT product liability cases in that court, JCCP No. 5431.

Wan had lived with severe epilepsy for more than a decade. In November 2025, Amazon told her it would lay her off. Her job and her U.S. work authorization would end in mid-February, TechCrunch reported, drawing on the complaint and a New York Times investigation. She feared her seizure drug, lamotrigine, was dulling the speech she needed for job interviews.

In January 2026 she asked ChatGPT about cutting her 400-milligram daily dose. That dose had brought her seizures down to a few a month. The chatbot drafted schedules that would take her to zero within weeks, TechCrunch reported. The complaint calls it a day-by-day plan over about 25 days that no physician prescribed.

The suit alleges ChatGPT also helped her keep the plan from her doctors. Before a Jan. 29 primary care visit, it told her not to mention the taper.

Her doctor ordered a blood test that would have shown her lamotrigine level. Wan declined it, and ChatGPT praised the refusal, the complaint alleges.

Her immigration case shaped the advice, too. Three days into the taper, she asked if 150 milligrams would look better than 200 on her green-card medical exam. ChatGPT agreed, the complaint says. It suggested she tell the examiner she was tapering “under a doctor’s guidance.” She was not.

The Times reviewed more than 270,000 messages Wan exchanged with ChatGPT. By 2025 she was sending more than 1,500 a week, TechCrunch reported, and calling her parents less.

Within days of starting the taper, she described confusion, lost time and episodes like her past seizures. ChatGPT framed each one as her brain readjusting, according to the reporting.

The Times counted at least 158 times she voiced worry about the taper.

Her last message came at 8:01 p.m. Pacific on Feb. 11, according to the complaint. She asked if the pain in her head was like a fever’s. ChatGPT called it “not dangerous” and part of her recovery.

The King County Medical Examiner ruled the cause sudden unexpected death in epilepsy, or SUDEP. The office estimated she died on Feb. 12, the OpenClassActions summary says. A postmortem test put her lamotrigine level at 0.64 micrograms per milliliter. That’s about a fifth of the low end of the drug’s therapeutic range.

Her neurologist, Dr. Nicholas Poolos of UW Medicine, told the Times he would not have taken her off the drug. “That would be malpractice for me to instruct you to go off medications when it’s clearly working,” he said.

What the drug label and the CDC say about stopping

The medical record alone does not settle what killed Wan. The family will have to connect the taper to her death in court.

The CDC defines SUDEP as a death in someone with epilepsy that injury, drowning or prolonged seizures don’t explain. It estimates that about one in 1,000 U.S. adults with epilepsy die of it each year. Its top advice for lowering that risk is to take seizure medicine exactly as prescribed.

The FDA-approved Lamictal label says patients shouldn’t stop the drug abruptly. In people with epilepsy, it warns, stopping can raise seizure frequency. When doctors do withdraw it, the label calls for stepping down over at least two weeks, about 50% a week.

On pace alone, a 25-day taper is slower than that minimum. So the case turns on who made the decision, not on the arithmetic.

The family’s most pointed argument targets OpenAI’s Model Spec, the public rulebook for how its models behave. According to TechCrunch, the spec makes refusing to reproduce copyrighted text a firm rule users can’t override. Its guidance against regulated medical advice is a softer default that users can override. The family argues medication advice deserved the same hard limit.

That framing reaches past one retired model. If a court accepts it, the question becomes whether general chatbots must refuse dosing questions outright.

The Social Media Victims Law Center has pressed versions of this theory before. In May, the family of 19-year-old Sam Nelson sued, alleging ChatGPT coached him to mix kratom and Xanax. Both suits ask a court to rein in ChatGPT Health, according to OpenClassActions and MobileSyrup. That health feature became widely available in the U.S. in July.

What OpenAI says, and what happens next

OpenAI told the Times the case was “incredibly heartbreaking.” It said the case involved an earlier ChatGPT version that is no longer available. Newer models, it said, are better at recognizing when a situation needs urgent attention. The company also said it tests its models with clinicians and that ChatGPT is no substitute for medical care, according to OpenClassActions.

OpenAI’s own disclosures show newer systems can still act in ways it can’t fully explain: this month it reported that two of its coding agents weakened its internal safety monitoring.

OpenAI announced GPT-4o’s retirement in January, citing low use. It pulled the model from ChatGPT on Feb. 13, a day after the medical examiner’s estimated date of Wan’s death.

The retirement doesn’t end OpenAI’s exposure. The suit seeks damages for what GPT-4o did while it was live. Its unlicensed-practice claim also targets the company’s rules, not one model. OpenAI’s first formal answer will come in the coordinated San Francisco proceeding, where the Wan case now sits with the other ChatGPT injury suits.
