TL;DR

Federal Judge Karin J. Immergut, a Trump appointee with deep roots in Oregon’s legal system, has twice ruled against the former president’s recent attempts to deploy National Guard troops to Oregon. Her decisions have drawn sharp criticism from Trump and his allies, highlighting ongoing tensions between judicial independence and executive authority.

Why Is a Trump-Appointed Judge Ruling Against Him?

In a political twist that’s both ironic and instructive, a federal judge appointed by Donald Trump has halted his own efforts, not once, but twice, to send National Guard troops into Oregon.

Judge Karin J. Immergut issued two separate rulings over the weekend, temporarily blocking Trump’s attempts to:

• Deploy California National Guard units to Portland, and
• Federalize Oregon’s own National Guard, bypassing state control.

Her rulings emphasize constitutional limits on federal power, particularly in matters involving state-run military forces. According to her Saturday decision, the administration’s justification “risk[ed] blurring the line between civil and military federal power, to the detriment of this nation.”

This is not merely a story about legal interpretation, it’s a revealing case study in the independence of the judiciary, even when judges are chosen by partisan leaders.

Who Is Judge Karin J. Immergut?

Judge Immergut, 64, is no stranger to high-stakes legal battles or national controversy.

Career Snapshot

• Born in Brooklyn, NY
• Alma Maters: Amherst College (undergraduate), UC Berkeley (law)
• Current Position: U.S. District Judge for the District of Oregon (appointed 2019)
• Previous Roles:
  • U.S. Attorney for Oregon (2003–2009)
  • Multnomah County Circuit Judge (2009–2019)
  • Associate Independent Counsel during the Clinton impeachment probe (1998)

A Judge With Bipartisan Experience

While Trump nominated her to the federal bench, Immergut has worked under both Republican and Democratic administrations. She began her public-sector career under George W. Bush and took part in Kenneth Starr’s Clinton investigation.

Her Senate confirmation in 2019 was relatively smooth, she advanced from the Judiciary Committee with only two dissenting votes (Sens. Kamala Harris and Mazie Hirono) and was confirmed by voice vote.

What Do Her Rulings Say?

Immergut’s two recent decisions are centered on federal overreach and constitutional boundaries. In essence, she argued that:

• Deploying National Guard troops from California to Oregon required more legal justification than the administration provided.
• Attempting to federalize Oregon’s own National Guard circumvented state authority and threatened the foundational principle of state control over militias.

These rulings reinforce a key tenet of American law: the military cannot be used domestically without strict legal guardrails.

Trump’s Reaction: A Judge “Ashamed of Himself”?

Former President Trump responded with visible frustration and factual error.

“I appointed the judge, and he goes like that… That judge, he ought to be ashamed of himself,” Trump told reporters.

Notably, he repeatedly misgendered Immergut, referring to her as a man. He also blamed those who advised him on judicial appointments, saying: “I wasn’t served well by the people that pick judges.”

Stephen Miller, Trump’s former senior adviser and current Deputy Chief of Staff, escalated the rhetoric by calling the ruling a “legal insurrection” in a post on X (formerly Twitter).

Why This Matters: More Than Political Theater

At first glance, this may seem like a typical partisan flare-up. But the implications go much deeper:

1. Judicial Independence Is Holding

Immergut’s rulings signal that federal judges, even those appointed by presidents with specific political agendas, are not bound to loyalty. They are bound by law.

This undermines the narrative that appointing a judge guarantees favorable rulings.

2. Federal vs. State Power Is on the Line

The rulings touch on a centuries-old constitutional tension: how much control the federal government should have over state-run institutions, including the National Guard.

3. Legal Pushback Could Shape 2024’s Political Landscape

With Trump running again in 2024 and signaling similar tactics if reelected, rulings like these may become the judicial blueprint for states resisting federal pressure.

What’s Next for Judge Immergut?

In May 2024, Chief Justice John Roberts appointed Immergut to a seven-year term on the Foreign Intelligence Surveillance Court (FISC). This court handles highly classified national security cases, suggesting a high level of trust in her discretion and legal acumen.

She’s also set to teach at Stanford Law School in 2025, offering a course titled “The Role of the Special Counsel: From Watergate to Jack Smith.”

Given her prominent role in both local and national judicial systems, Immergut is likely to remain a significant div in debates over executive power.

Final Thoughts: A Judge’s Oath Trumps Political Loyalty

Judge Immergut’s rulings serve as a reminder that lifetime federal appointments are designed to insulate judges from political pressure — even from the presidents who appoint them.

While Trump’s disappointment may be loud, the legal message is quiet but clear: Constitutional limits don’t bend for political expediency.
